Your use of this site, placement of an order or submission of any purchase order to Golden Motor Canada indicates full understanding and acceptance of all of the terms and conditions set forth on this entire page. These terms and conditions shall supersede any subsequent terms or conditions included with any purchase order. Golden Motor Canada reserves the right to make changes to (or amend) any information on this site and these terms and conditions at any time.

If you do not completely understand the warranty, liability agreement or any of the Terms and Conditions set forth on this page, please consult an attorney before purchasing any of our products. Remember to always wear a helmet and protective gear. We are not liable for injury resulting from the use of this or any other product. The purchaser of any product offered on this web site agrees that he or she fully understands and agrees to be bound by all of the terms and conditions set forth on this web page and also agrees to submit any disputes arising out of operation or use of any product offered here to arbitration. To validate warranty registration the purchaser of a motorized scooter may be required to sign, initial and return a form provided by Golden Motor Canada and/or the original distributor or manufacturer that outlines all of the terms and conditions set forth on this web page by Golden Motor Canada and/or the original distributor/manufacturer.

It is the responsibility of the end user to obtain and obey all the applicable local, state, provincial and federal laws in regard to the use of any product offered on this website. If you are unsure or in doubt, please consult your local, state and provincial laws before ordering. The buyer represents that any products ordered will only be used in a legal and lawful manner in accordance with the laws and regulations of the buyer’s province or state. The buyer accepts the product on the condition that he/she assumes all risk to persons or property arising from the use or handling of this product. Any of our motors and controller combinations can be programmed to help you operate product with in legal street limits. If you do not take these precautions then you must use these products for off-road use only. Some provinces or states may have additional restrictions.

The purchaser of any product offered on this web site agrees to: 1. Wear approved safety equipment at all times including but not limited to, helmet, goggles, leg and arm protection, gloves and hearing protection. 2. Always check for proper functioning of your equipment including steering, brakes, drive train, tires, throttle, kill switch and all fasteners. 3. Perform all necessary repairs and maintenance before operation. 4. Keep hands and any other body parts and any foreign objects clear of moving parts, including chain or spindle drive. 5. Not wear any loose clothing or articles, which could become entangled in the unit. 6. If under 18 years of age only operate electric pedal bikes with adult supervision. Person under 16 are forbidden to operate Ebikes by punishment of Law. (Required at all times). 7. Not double ride. All products offered here are intended for use by one operator. 8. Not to operate at night or when visibility is limited, and to avoid busy areas and steep inclines. 9. If pregnant or if any other health concerns exist, consult a physician before using any or our products. 10. When braking, lean back to maximize control. Never lock the front brake, doing so will cause loss of steering control. 11. Not attempt to use or permit the use of this product unless the user has proven ability and skill in the control of a non-assisted bike of a similar type.

WARRANTY POLICY

All of our products have a full one year warranty for non commercial use. If an issue arises with a product, please contact us so our staff can attempt to trouble shoot the problem. We may ask to you conduct tests to determine the exact problem. If the staff determines that the issue cannot be resolved with remote communication, the customer will have to ship the item back to us at their expense. Once the product is received, examined and confirmed that the issue is not due to customer negligence; we will repair or replace the product and ship it back. If it is determined that the product failure occurred due to customer negligence, in that case the support team will estimate the repair or replacement cost plus shipping and bill the customer. Once the estimate has been paid, the staff will perform the repair or replacement and ship it back to the customer. If the customer decides that they do not want the item repaired or replaced, the customer can pay the shipping to have it returned or it will simply be discarded.

The warranty does not cover damage to the unit caused by: 1. Defects, malfunction, or failures resulting from abuse, misuse, modifications, alterations, improper storage, use of unauthorized attachments including failure to provide or perform required maintenance services. Preventive maintenance is the warranty holder’s responsibility. 2. Damage caused by dirt or corrosion in all of this forms, including, but not restricted to rust, salt water, varnish and moisture. 3. Failure to follow the setup, pre-delivery service, and adjustments. 4. Damage caused by pressure, or steam cleaning of the product. 5. General wear and tear. 6. Damage caused during any form of racing, commercial use, crash damage included but not limited to fork or F.T.C damage or any use deemed improper by Golden Motor or the original distributor/manufacturer, acting reasonably.

Golden Motor or the original distributor or manufacturer’s, sole obligation under this warranty is to replace or repair, at its option, any part found to be defective. Parts replaced or repaired under this warranty are warranted only for the balance of the warranty period. All defective parts replaced under warranty become the property of Golden Motor or the original distributor or manufacturer. For warranty repairs, you must at your expense, arrange shipment for both delivery and return your product to Golden Motor. This limited warranty is in lieu of all other warranties. Any implied warranty of fitness for a particular purpose, merchantability or otherwise, is specifically denied. Some states do not allow how long an applied warranty lasts so the above limitation may not apply to you. This warranty gives you specific legal rights, and you may also have specific legal rights that vary state to state, province to province or country to country.

SHIPPING POLICY

We can ship to virtually any address in the world. Note that there are restrictions on some products, and some products cannot be shipped to international destinations. When you place an order, you will be presented with one or more shipping options for you to chose from. Please also note that the shipping rates for many items we sell are weight-based. The weight of any such item can be found on its detail page. To reflect the policies of the shipping companies we use, all weights will be rounded up to the next full pound.

Some countries are not as “shipping friendly” as others and the shipping charged will not be enough to get the products to you. If this is the case we will contact you and offer you to pay the additional charges before we ship or we will refund you 100 percent of the transaction.

SHIPPING AND PROCESSING TIMES

When you place an order and the item is in stock we do our best to ship it within 24 to 48 hours. In most cases all the orders placed before 2 PM EST will ship the same day. We do our best, but that is not always possible. At peak times it can take an extra day or two to get the shipment out but we do our best to avoid these delays. Honestly we do our best, but we can’t perform miracles.

ADDITIONAL COSTS

In most cases once we ship your products will arrive in a timely fashion to your door. Once we ship if any additional cost arises like customs fees, brokerage fees, duty, tariffs, taxes, additional shipping costs or currier costs or any additional charge to get the products to you become your responsibility.

PRODUCT RECEIVED IS DAMAGED

If you receive a product damaged it must be reported immediately.

If there is any damage to the box please take pictures before you open it and report the damages to the courier immediately before you receive it. Our items usually get shipped by Canada post and if anything comes damaged take pictures before you receive it or if you are not home, please have whoever is home just refuse it. Have them tell the courier to send it back to your local post office so the correct person can pick it up. They have no problem with this if you tell them. You can then go and pick it up later. Please take pictures of the damages and the label while it is on the counter at the post office before receiving it. If there are damages all our shipments are insured and you may need to prove the box was damaged. Even if the box is damaged you must still accept it before they send it back. Usually within 5 days. Any claim of damage will be ignored. They will charge us for shipping it back to us and then back to you again.

Please also keep in mind our shipments are packed very well and the boxes can be incredibly beaten up and the product still arrives fine.

RETURNS POLICY

You may open the product and look at it of course. You can inspect it and judge the quality of the product.

We are not in this business to waste our time or yours. We are not in the business of letting people try out products to see it they like them. Please don’t order anything unless you intend to keep it. If you have an issue and you purchased from Golden Motor Canada our reputation is rock solid. Google it!

If the product is installed or used in any way you have accepted the product and a return will not be possible. If the product is not functioning correctly please see our warranty policy. Remember Rock Solid!

You may return most new, unused items within 10 days of delivery for a Store credit. We do not credit the original cost of shipping the product to you or the cost of you shipping the product to us. There will also be a 20 percent restocking fee.

If there is any customs charge, tax or any fee paid to receive an item back this amount will be also deducted from the credit.

You should expect to receive your credit within two to three weeks of giving your package to the return shipper; however, in many cases you will receive a refund more quickly. This time period includes the transit time for us to receive your return from the shipper (5 to 10 business days), the time it takes us to process your return once we receive it (3 to 4 business days).

We will notify you via e-mail of your store credit once we’ve received and processed the returned item.

DISCLAIMER AND LIMITATION OF LIABILITY AS TO PRODUCTS SOLD

EXCEPT AS EXPRESSLY STATED HEREIN, GOLDENMOTORCANADA MAKES NO REPRESENTATIONS OR WARRANTIES, EITHER EXPRESS OR IMPLIED OF ANY KIND WITH RESPECT TO PRODUCTS SOLD ON THE GOLDEN MOTOR CANADA SITE. EXCEPT AS EXPRESSLY STATED HEREIN, GOLDEN MOTOR CANADA EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, OF ANY KIND WITH RESPECT TO PRODUCTS SOLD ON THIS WEB SITE, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. YOU AGREE THAT THE SOLE AND EXCLUSIVE MAXIMUM LIABILITY TO GOLDEN MOTOR CANADA ARISING FROM ANY PRODUCT SOLD ON OR AS A RESULT OF THE GOLDEN MOTOR CANADA SITE SHALL BE THE PRICE OF THE PRODUCT ORDERED. IN NO EVENT SHALL GOLDEN MOTOR CANADA, IT’S DIRECTORS, OFFICERS, EMPLOYEES AND REPRESENTATIVES BE LIABLE FOR SPECIAL, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES RELATED TO PRODUCTS SOLD.

Purchaser herewith acknowledges and agrees Golden Motor Canada or the original distributor or manufacturer assumes no liability for any equipment and herewith assumes the risk of any injury arising from operation of any products offered on this web site. The original owner (person who purchases from Golden Motor Canada or the original distributor or manufacturer) will indemnify and hold Golden Motor Canada or the original distributor/manufacturer harmless and take full responsibility for all safety warnings, instructions, and limited warranty if unit is sold, lent or otherwise transferred and will indemnify Golden Motor Canada or the original distributor or manufacturer, it’s officers, agents or assignees from any claims against failure to do so.

Integration:
This agreement sets forth the entire understanding of the parties with respect to the subject matter hereof, and supersedes all prior discussion, negotiations, understanding, letters or written agreements among the parties hereto relating to the subject matter contained herein, and all prior discussions are merged herein. This Agreement may not be varied, altered, modified, changed, or in any way amended except by an instrument in writing, executed by the parties hereto.
